Meeting Minutes
for
Monday, April 18, 2005 at 4:00 PM

Present:  Vice Chair James Reilly, Mr. Jay bradshaw, Mr. Bruce Engle, Ms. Jill Fox, Ms. Teresa Yanga (sitting in for Mr. Matthew O. Franklin), Sister bernie galvin, Ms. Ana B. Gutierrez and Mr. leroy moore, Jr. 

Absent:  Chair Richard lee, Ms. Jamie Armstrong, Mr. Scott clark, Mr. tomas lee and Mr. Ben Rosenfield

  1.       Roll Call
         
    Chair Reilly called the meeting to order at 4:10 PM.  Roll call was conducted and a quorum was recognized, with five members absent.  Mr. Moore arrived at 4:30 PM.

    2.  Approval of Minutes of Last Meeting
         
    A motion to approve the March 21, 2005 meeting minutes was made by Mr. Bradshaw and seconded by Ms. Gutierrez.  The committee unanimously approved the motion.

    3.  Director’s Report

    None

    4.  Consideration of Main Menu

    (a)  Wilde Avenue @ Alpha Site

    Ms. Joan McNamara, Program Manager, presented follow-up data pertaining to dimension specifications required for development of the site and disposition recommendation.  Ms. McNamara reported that the site as currently zoned is not developable because it does not meet the city’s minimum lot width requirement.  In order to develop a single family residence on the site, a property owner would need to submit a proposal to the Department of City Planning for a conditional use permit.  Staff recommended the following resolution for the site:

    “That the city begin working with private housing developers such as Habitat for Humanity to determine their interest in developing a single family residence on the parcel that is consistent with the Surplus City Property Ordinance.  If these organizations are not interested, staff recommended that the parcel be sold with the proceeds going toward other chronically homeless developments.”

    Ms. Fox inquired what the fair market value of the parcel would be without a conditional use permit.  Ms. McNamara responded that the fair market value of the parcel without a conditional use permit is whatever the general public is willing to pay for under the circumstances.  If a conditional use permit is obtained from the Department of City Planning, then staff estimated that the parcel would be worth approximately $100,000 to $150,000.

    Chair Reilly inquired if city properties are ever sold subject to the buyer applying for and obtaining a conditional use permit.  Mr. Jerry Romani, of the Department of Real Estate, responded that the city would normally rezone a parcel from P to the appropriate zoning for the district before putting the property out to bid at auction.  In the case of the Wilde parcel, the city would also try to obtain a conditional use permit so that the true market value of the property could be determined.

    Mr. Engle inquired if it is feasible to sell a property with a contingency that the buyer is to obtain a conditional use permit.  Ms. Amy Brown, Deputy City Attorney, responded that the city have on occasions required such a contingency; however, it’s typical on much larger developments that economically make sense.

    Public Comment
    Mr. Russell Morine, of Habitat for Humanity, commented that Habitat would like to build an affordable single family home on the site if it is feasible.

    Mr. Bradshaw made a motion to adopt the resolution recommended by staff.  The motion was seconded by Sister Galvin and unanimously approved.

    (b) Informational Presentation

    Ms. Teresa Yanga, Senior Project Manager at the Mayor’s Office of Housing, gave a presentation on the basics of planning and developing affordable housing in San Francisco, including key components of the development process and the financing of affordable housing.

    (c)  Staff Report on Schedule for 2005

    Mr. Lipski presented anticipated dates for scheduling presentation of data pertaining to the suitability of the remaining 2003/2004 sites for priority uses under the Surplus City Property Ordinance.  Mr. Lipski informed the committee members that staff is completing the feasibility studies for the 150 Otis Street site and will be presenting the item at the May 16 meeting.  Staff will present the 341 Corbett St. site at the June 20 meeting and Roosevelt Way at the July 18 meeting.  For the 201 Broadway and Sansome site, the Mayor’s Budget Office is still working with other city departments on the $3 million debt that is tied to the sale of the site.  As for the 155 Grove Street site, the Director of MOH is reviewing the committee’s recommendation for the Request For Proposal.

    5.  Committee Members’ Questions and Matters
    Sister Galvin inquired if it would be possible to hold the meeting earlier from 3:00 PM – 5:00 PM instead of 4:00 PM – 6:00 PM.

    Mr. David Zisser, of the Coaliton on Homelessness and Land and Liberty Coalition, informed the committee that there would be two forthcoming memos from the coalition.  Mr. Zisser wanted to reiterate that under the Surplus City Property Ordinance, the proceeds from the sell of the properties are required to be used for housing for the homeless and not just affordable housing.  The coalition’s other concern relates to the general process under the ordinance.  Mr. Zisser stated that under the ordinance, the CAC is required to make recommendations directly to the Board of Supervisors and not to the Mayor’s Office of Housing (MOH).  MOH is welcome to review the CAC’s recommendations, but the Board of Supervisors is supposed to balance the recommendations from the CAC and MOH.
